Terms of Use (TOU)

Preamble

These Terms of Use (hereinafter “TOU”) govern all services provided by Trustiatis LLC, a company registered in the State of New Mexico (United States):

Trustiatis designs, deploys, and maintains professional and hybrid IT environments, including hosting, managed services, telephony, IoT, cybersecurity, and integrated ERP/CRM software.

These TOU apply to all users (businesses, institutions, individuals) accessing a Trustiatis service, on-site, online, or via removable media.

Article 1 – Purpose and Scope

These TOU define the rights and obligations of the parties regarding the use of digital and IT services provided by Trustiatis LLC, including:

Trustinstance: managed servers and hosting
Trustiastack: ERP/CRM, business applications, web hosting, and professional email
Trustiaboot: configured and secured portable systems
Professional VoIP, Fax, and SMS services
IoT solutions (SIM/eSIM and associated hardware)
Consulting, DevOps, SOC, and cybersecurity services

Article 2 – Definitions

Client / User: any natural or legal person using a Trustiatis service.
Provider / Partner: third-party entity contributing to service delivery.
Trustiatis Services: all solutions, platforms, and tools provided.
Contract: comprised of the quotation, specific conditions, and these TOU.
License: the right to use a software or integrated component.

Article 3 – Nature and Limits of Services

Trustiatis acts as a technology provider and managed service integrator, not as a telecom operator or financial services provider.

Services rely on secure, hybrid, multi-provider infrastructures and are delivered within industrial standards and applicable U.S. and international laws.

Trustiatis cannot be held liable for illegal, fraudulent, or unlawful use in the Client’s jurisdiction.

Article 4 – Legal Compliance (KYC / AML / OFAC / Patriot Act)

4.1 – Identification and Compliance

Trustiatis LLC applies U.S. international compliance and anti-money laundering (AML) rules, including the USA PATRIOT Act, Bank Secrecy Act (BSA), and Office of Foreign Assets Control (OFAC) directives.

Trustiatis reserves the right to:

verify Client identity (KYC – Know Your Customer) before activating a service;
suspend or refuse services in case of suspected fraud, money laundering, terrorism financing, or sanctions evasion;
report any suspicious transaction or activity to U.S. authorities (FinCEN, OFAC, FBI, DHS) as required by law.

4.2 – Sanctions and Restrictions

Trustiatis services cannot be provided to individuals or entities:

listed on OFAC, EU, UN, or other sanction lists;
located in embargoed countries or territories (e.g., Iran, North Korea, Syria, Crimea, Cuba, etc.);
using our products for military, terrorist, or illegal surveillance purposes.

Non-compliance results in immediate and permanent contract termination, without refund, with notification to the competent authorities.

Article 5 – Software Licenses and Usage Rights

5.1 – Proprietary Licenses

Certain software, systems, and modules used in Trustiatis offerings (e.g., Microsoft, Oracle, VMware, Telnyx, AWS) are subject to proprietary licenses.
Clients acknowledge that these rights remain the exclusive property of their holders.

Trustiatis holds the necessary authorizations for deployment and guarantees their use within the defined contractual framework.

5.2 – Open Source Licenses

Trustiatis also integrates open-source components under licenses such as:

GNU GPL / LGPL
MIT / BSD
Apache 2.0
MPL
EUPL

These rights remain open, and integration within Trustiatis managed environments does not imply transfer or assignment beyond what is provided by the original license.

5.3 – Trustiatis-developed Software

Internal tools, scripts, configurations, interfaces, or extensions produced by Trustiatis during a project are protected under the U.S. Copyright Law (17 U.S.C.).
They may not be copied, reproduced, or redistributed without written consent.

Article 6 – Data Security and Compliance

Trustiatis applies international security standards:

ISO/IEC 27001 (security management)
SOC 2 Type II
GDPR for EU residents
HIPAA for health data where applicable

Servers are located in highly secure data centers operated by AWS, Oracle, OVHcloud, Infomaniak, Hostinger, and other approved partners.

Data is encrypted in transit (TLS 1.3) and at rest (AES-256). Trustiatis does not access Client content except upon explicit request or legal requirement.

Article 7 – Liability

Trustiatis is only bound by an obligation of means. The company cannot be held liable for:

data loss due to inappropriate or external use (malware, phishing, hacking);
failures caused by independent third-party providers;
Client non-compliance with local legal obligations.

Maximum liability is limited to the total amount paid by the Client over the last 3 months for the concerned service.

Article 8 – Consumer Protection (B2C)

Individual clients benefit from a 14-day withdrawal right from the order date, except for orders already placed and non-refundable with our providers.
In such cases, services will be directly transmitted to the relevant provider, and the individual must exercise the withdrawal rights directly with that provider under applicable law.

Professional services (B2B) remain firm and non-refundable after activation, according to established contracts.

Article 9 – Jurisdiction and Applicable Law

These TOU are governed by the laws of the State of New Mexico (USA).

In case of dispute, parties agree to prior mediation. Failing amicable settlement, courts of Bernalillo County (NM, USA) shall have exclusive jurisdiction.

Article 10 – Technical Partners and Providers

Trustiatis LLC works with multiple infrastructure and service providers to ensure reliability, security, and performance.
All providers are subject to strict confidentiality and data protection agreements in compliance with international regulations (GDPR, Swiss LPD, PIPEDA, U.S. federal and local laws).

💡 Important Note: Trustiatis LLC is not responsible for any breaches, interruptions, failures, data loss, or security incidents caused by these providers. Clients acknowledge that the use of their services is at their own risk and under each provider’s terms.

💡 Final Note: Trustiatis ensures that all data hosted or processed via these providers complies with minimization, security, and regulatory principles according to its privacy policy. Responsibility for contractual, technical, or legal obligations remains with each provider.

Article 11 – Acceptance

By using Trustiatis services, the Client acknowledges having read, understood, and accepted these TOU, including legal compliance clauses, security obligations, and software license restrictions.
